Telephone Pre-filing Credit Counseling Disclosures

Dollar Learning Foundation Inc. is a non-profit agency and is tax-exempt under Section 501(c)(3) of the Internal Revenue Code.

Dollar Learning Foundation Inc.’s teachers/instructors have received certification as a Certified Credit Counselor or equivalent by a recognized independent organization, such as the National Association of Certified Credit Counselors (“NACCC”).

Dollar Learning Foundation Inc. is funded solely by the fees paid for our Credit Counseling and Post-filing Debtor Education (Personal Financial Management Course) courses. Dollar Learning Foundation does not pay or receive fees or other consideration for the referral of students who take this course. Dollar Learning Foundation Inc. does not receive funding from any other source or outside the organization. However, future funding may be in the form of donations and contributions from other entities that support financial education and literacy.

Dollar Learning Foundation will charge a fee for the telephone Pre-filing Credit Counseling Course for single filers of $20.00 (There is an additional $10 charge for joint course takers) via credit card or debit card; these payment methods are accepted for an additional convenience fee of $6.49. Check and money orders mailed to DLF are not assessed the convenience fee. Mailed payments must be made payable to Dollar Learning Foundation, Inc. and mailed to 21550 Oxnard St, 3rd Flr, # 48, Woodland Hills, CA 91367 complete with your name, address, phone number, and email address. Please allow up to 7-10 business days for us to receive and process mailed payments. Telephone registration services are available for a fee of $6.50; this fee does not apply to telephone course registrations completed online. Urgent fax certificate dispatch and U.S. Postal Service certificate delivery are available for $12.99 each. $9.99 is the fee for the extension of counselor, online, and phone support hours provided beyond normal business hours. Instant delivery of your certificate to a preferred email at the completion of your follow up session for $8.99; delivery of non-expedited certificates can take up to 1 business day. Confirmation of delivery of your certificate to other non-personal email address for $9.99. $5.99 is the service fee. Duplicate certificate copies via email and unlimited corrections to the certificate of completion are available for a fee of $18.99. $12.99 is the fee for the extended access to your course records past the mandatory 2-year retention period. These fees are the same for all approved judicial districts. A student may also use an Attorney Access Code which you may obtain from your attorney if he or she is a Dollar Learning Foundation Inc. subscribing attorney. Please contact your attorney if you are unsure of whether your attorney has an Attorney Access Code.

Dollar Learning Foundation Inc. provides services without regard to a client’s race, religion, national origin, gender, social position, handicap, financial status or ability to pay. Dollar Learning Foundation Inc. will waive the course fee if the current household income is 150% or less of the Federal Poverty Level Guidelines last published by the United States Department of Health and Human Services for the size of your household and your financial circumstances. Course fee reductions may be given to clients who have special and unique situations. Dollar Learning Foundation Inc. may also waive the fee if your attorney represents you pro bono. Please note that to receive a fee waiver you will be asked to provide proof of monthly household income/size or documentation of pro bono service.

To determine your eligibility for a Fee Waiver, you will need to provide us with the following information: - Your State of Residence - The number of persons currently living in your household - Your total annual household income

Once it is determined that you are eligible for a Fee Waiver, you will need to provide us with documentation supporting your current household size and annual household income, as well as your contact information. - Proof of current household size may be your income tax return or other government document that shows proof of household size. - Proof of current household income may be provided by submitting your most recent Income Tax Return or W2’s, your three most recent pay stubs, your unemployment certificate, or a statement of benefits obtained from the government or Social Security Administration. - Contact information including Full Name and Email/Phone Number

If you are unable to provide proof of either household size or income, you will need to submit a narrative describing in detail the reason why.

Once Dollar Learning Foundation receives ALL supporting documentation, Dollar Learning Foundation will respond within 3 business days via the contact information you submitted and provide you with a Fee Waiver Code.

If you do not qualify for a Fee Waiver due to your current household income being more than 150% of the Federal Poverty Level Guidelines last published by the United States Department of Health and Human Services, you may still request a Fee Reduction by emailing support@dollarbk.org with a short explanation of the special circumstances that qualifies you for fee reduction based on your inability to pay the course fees. For our course fees, please refer to DLF’s fee schedule above.

Please Note: Approval for a Fee Waiver/Reduction of the counseling fees must be received BEFORE the course is started. Refunds will not be given after the fact.

Dollar Learning Foundation Inc. has secured the approval of the United States Trustee to provide Credit Counseling Courses and Personal Financial Management Course courses. The United States Trustee has only reviewed Dollar Learning Foundation’s Credit Counseling and Personal Financial Management Courses. United States Trustee has not reviewed any other non-counseling/instructional services. Approval does not endorse or assure the quality of an Agency’s services.

Dollar Learning Foundation Inc. does not report any of its clients or information to any credit reporting agency and the sole use of Dollar Learning Foundation's services should not have any direct impact on your credit report. Our Credit Counseling Course discusses bankruptcy and alternatives to bankruptcy that may have a negative impact on your credit score. Some of these alternatives include but are not limited to debt management plans, debt settlement, and consumer work outs with creditors. Although a Debt Management Plan (DMP) provider may not report your participation in their DMP to credit reporting agencies, your creditor(s) may report your participation in the DMP to credit reporting agencies. As a result, some creditors may view your DMP participation negatively and may not extend additional lines of credit to you. Bankruptcy may help you erase or pay off past debts, but those accounts will not disappear from your credit report. All bankruptcy-related accounts will remain on your credit report and affect your credit score for seven to 10 years, although their impact will lessen over time.

Dollar Learning Foundation Inc. maintains all client information in the strictest confidence. Dollar Learning Foundation Inc. will not disclose any information you disclose orally or in writing to any third party without your written consent, except as may be required by law such as a subpoena. However, Dollar Learning Foundation might disclose client information to the United States Trustee in connection with the United States Trustee's oversight of the agency, or during the investigation of complaints, during on-site visits, or during quality of service reviews.

The Credit Counseling Course offered by Dollar Learning Foundation Inc. is offered in English and Spanish only. For clients who wish to receive Credit Counseling in another language, please go to the United States Department of Justice’s website for a list of agencies that provide services in other languages – http://www.justice.gov/ust/eo/bapcpa/ccde/cc_approved.htm

The Pre-filing Credit Counseling Course is broken up into two parts. First, there is a pre-recorded telephonic component where you will listen to the course modules; second a follow-up counseling session with a certified counselor by phone where you will create a household budget and action plan.

The pre-recorded telephonic component of Dollar Learning Foundation Inc.’s Pre-filing Credit Counseling Course is available 24 hours a day, 7 days a week. Our credit counselors are available during normal business hours. Your counseling will not be complete until you have completed the follow-up phone call. At the conclusion of your follow-up counseling/briefing, Dollar Learning Foundation Inc. will only provide you with an official Certificate of Counseling upon completion of the counseling services. Dollar Learning Foundation has an obligation to provide a certificate to the client promptly upon completion of the counseling services. Your certificate of completion is generated after you complete your live follow-up with a counselor. Please note that your certificate will be dated with the date of the one-on-one counseling, not the date you finished the pre-recorded telephonic component of the counseling.

Dollar Learning Foundation Inc. has an obligation to email a copy of your certificate of completion promptly to the email address you provided during registration once the counseling session is complete. If you are working with an attorney, your certificate of completion will be emailed to him or her as well if you provided his or her email address during registration. You are solely responsible for following up with your attorney to ensure that the certificate has been received by your attorney. Dollar Learning Foundation Inc. will not be liable for certificates that are lost during transmission; however, we will resend the certificate at your request.

You have the opportunity to negotiate an alternative payment schedule or debt management plan (DMP) for your unsecured debt. Dollar Learning Foundation Inc. does not provide this service and may refer you to another agency for this service. You may incur additional fees in connection with a debt management plan.

Dollar Learning Foundation Inc. is a non-profit corporation that provides financial literacy programs to individuals that are suffering from financial distress. Dollar Learning Foundation Inc. provides consumers with education, personal financial management tools, and the required Pre-filing and Post-filing bankruptcy courses. The Pre-filing Credit Counseling Course is required for persons who are contemplating filing U.S. bankruptcy proceedings and the Post-filing Debtor Education Course is required for persons who have filed U.S. bankruptcy proceedings. Persons filing bankruptcy are required to present a Credit Counseling Course completion certificate to file for consumer bankruptcy and a Debtor Education Course completion certificate for the Court to approve his or her bankruptcy petition. Dollar Learning Foundation Inc. is approved by the United States Department of Justice (DOJ) to provide these Courses in the states listed on the DOJ website. Approval does not endorse or assure the quality of an Agency’s services.

Nothing herein shall apply to actions or claims under the provisions of the United States Bankruptcy Code, 11 U.S.C. Sec. 101 et seq.

Responsible Use and Conduct
By visiting our website and accessing the information, resources, services, products, and tools we provide for you, either directly or indirectly (hereafter referred to as 'Resources'), you agree to use these Resources only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations and generally accepted online practices or guidelines.

In order to access our Resources, as well as the Pre-filing and Post-filing certificates, you will need to submit specific information concerning yourself and information that identifies your bankruptcy case. Dollar Learning Foundation Inc. will only ask for the information needed to issue your course completion certificates. You agree that any information you provide will always be accurate, correct, and up to date. If information is missing or potentially inaccurate, you will be contacted by phone or email by a Dollar Learning Foundation Inc. representative. Dollar Learning Foundation Inc. is not responsible for any adverse outcomes that are the result of the specification of inaccurate personal information. Please read the Dollar Learning Foundation Inc. Privacy Policy to understand how Dollar Learning Foundation Inc.protects your personal information.

b. You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Resources. Accordingly, you are responsible for all activities that occur under your account/s.
c. Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means.
d. Engaging in any activity that disrupts or interferes with our Resources, including the servers and/or networks to which our Resources are located or connected, is strictly prohibited.
e. Attempting to copy, duplicate, reproduce, sell, trade, or resell our Resources is strictly prohibited.
f. You are solely responsible any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.

g. You agree to indemnify and hold harmless Dollar Learning Foundation Inc. and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.

Fees for Services

Prior to taking a course with Dollar Learning Foundation Inc. you will be required to pay the necessary fee for the course and the issuance of the course completion certificate. To make that payment, you will be requested to submit either your credit/debit card information, through which the specified fee can be paid immediately. In order to successfully complete a course, you must finish all the required financial learning modules and accompanying course assessments.

Refund Policy

Student debtors are required to send a written request regarding the refund. Student debtors with incomplete accounts will be issued a full refund. Refund requests that meet this criteria are processed immediately upon receipt of the written request either by email or by fax.

Privacy Policy
Your privacy is very important to us, which is why we've created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Our privacy policy is included under the scope of this User Agreement. In order to protect your personal privacy while still assuring that you will be able to secure your desired course completion certificate(s), Dollar Learning Foundation Inc. will assign you a personal account number and then you will be able to select your own personal password. In addition, you will be asked to provide a personal security question and the answer, so that you will be able to access your account if you forget your account password.

Limitation of Warranties
By using our website, you understand and agree that all Resources we provide are "as is" and "as available". This means that we do not represent or warrant to you that:
i) the use of our Resources will meet your needs or requirements.
ii) the use of our Resources will be uninterrupted, timely, secure or free from errors.
iii) the information obtained by using our Resources will be accurate or reliable, and
iv) any defects in the operation or functionality of any Resources we provide will be repaired or corrected.
Furthermore, you understand and agree that:
v) any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
vi) no information or advice, whether expressed, implied, oral or written, obtained by you from Dollar Learning Foundation Inc. or through any Resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.

Limitation of Liability
In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Dollar Learning Foundation Inc. will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.

Governing Law
This website is controlled by Dollar Learning Foundation Inc. from our offices located in the state of California, USA. It can be accessed by most countries around the world. As each country has laws that may differ from those of California, by accessing our website, you agree that the statutes and laws of California, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.


Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts located in USA, California. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Guarantee
UNLESS OTHERWISE EXPRESSED, Dollar Learning Foundation Inc. EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
